These Terms and Conditions (“Terms“) govern your use of this website and any booking enquiry, quotation request or service enquiry you make through it. The website is operated by C & J JAGOS PTY LTD (ABN 98 121 201 698), trading as Shire Tune & Service (in these Terms, “we”, “us” or “our”).

By accessing or using this website, you agree to these Terms. If you do not agree, please do not use this website.

1. About this website

This website is operated on our behalf by a third-party platform provider (AutoPal) which supplies the website infrastructure, booking form, conversion tracking and call-routing technology. AutoPal is a service provider to us. Your contract for any vehicle service, repair, inspection, or other work performed by us is between you and us; AutoPal is not a party to any such contract and provides no warranty in relation to the goods or services we supply.

2. Use of this website

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use this website for your personal, non-commercial use only. You agree not to:

  • Use this website in any way that breaches any applicable law or regulation
  • Use this website to send unsolicited commercial communications
  • Attempt to gain unauthorised access to this website, the server it is hosted on, or any related computer system
  • Use any robot, spider, scraper or other automated means to access this website without our express written permission
  • Copy, reproduce, republish, distribute, or commercially exploit any content on this website without our express written permission
  • Submit any false, misleading, or fraudulent information through any form on this website

3. Booking enquiries and quotations

3.1 Enquiries are not bookings

Submitting a form or making a telephone enquiry through this website is an enquiry only. It does not create a booking, a contract for the supply of services, or a binding obligation on us to provide any service. A booking is only confirmed once we have:

  • Confirmed the booking with you in writing (including email or SMS), or
  • Verbally confirmed the booking with you by telephone.

3.2 Quotations

Any quotation, estimate, or indicative price provided through this website or via telephone is an estimate only based on the information you have provided. The final price for any service may differ from the initial quotation depending on the actual condition of the vehicle, the parts required, additional work identified during inspection, or other factors. We will use reasonable efforts to inform you of any material change to the quoted price before performing additional work. Quotations are valid for the period stated in the quotation, or if no period is stated, for 14 days from the date of issue.

3.3 Vehicle information

Where you supply a vehicle registration number, we may use a third-party vehicle data service to retrieve information about the vehicle (such as make, model and year). You acknowledge that:

  • The information returned by the third-party service is provided “as is” and we do not warrant its accuracy or completeness
  • You remain responsible for verifying the accuracy of any vehicle details before any work is performed
  • We are not liable for any work performed in reliance on incorrect vehicle information that you have supplied or that has been returned by the third-party data service

3.4 Cancellations and no-shows

If you wish to cancel or reschedule a confirmed booking, please contact us as soon as possible using the contact details in Section 11. We may charge a reasonable cancellation fee if you cancel within 24 hours of the booking time, or if you fail to attend a confirmed booking, to cover the costs we incur in preparing for the booking. Any such fee will be notified to you at the time of booking confirmation.

4. Pricing and payment

All prices displayed on this website or in any quotation are in Australian Dollars (AUD) and are GST inclusive unless stated otherwise. Payment is due in accordance with the terms agreed between you and us at the time of booking confirmation. We accept the payment methods notified to you at the time of booking. Title in any parts supplied remains with us until payment in full has been received.

5. Performance of services

We will perform any services with reasonable care and skill and within any agreed timeframe. We will use reasonable efforts to identify and raise any additional issues we discover during the course of work, and will not perform additional work without your authorisation except where the additional work is necessary to make the vehicle safe.

Australian Consumer Law guarantees. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel the service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the service rectified within a reasonable time. If this is not done, you are entitled to a refund for the service. For major failures with the goods supplied as part of any service, you are entitled to a replacement or refund and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

6. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

Subject to the paragraph above, and to the maximum extent permitted by law:

  • This website and its content are provided “as is” and “as available”, without warranty of any kind, either express or implied
  • We do not warrant that this website will be uninterrupted, error-free, secure, or free from viruses or other harmful components
  • We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, loss of goodwill, or loss of opportunity, arising out of or in connection with your use of this website or any services obtained through it
  • Our total aggregate liability to you in connection with these Terms or any service we provide, however arising (including in contract, tort (including negligence), breach of statutory duty or otherwise), is limited to the amount you have actually paid to us for the specific service that gave rise to the claim, or AUD $100, whichever is greater
  • We are not liable for any act, omission, default or negligence of any third party, including the third-party platform provider, payment processors, telecommunications providers, vehicle data providers, or other suppliers

Where any consumer guarantee or implied term cannot lawfully be excluded but can be limited, our liability is limited, at our option, to:

  • For services: re-supplying the services, or paying the cost of having the services re-supplied; and
  • For goods: replacing the goods, supplying equivalent goods, repairing the goods, paying the cost of replacing the goods or acquiring equivalent goods, or paying the cost of having the goods repaired.

7. Indemnity

You agree to indemnify and hold us, our directors, officers, employees, contractors and the operator of this website (AutoPal) harmless from and against any claim, liability, loss, damage, cost or expense (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms
  • Your breach of any applicable law or regulation
  • Any false, misleading or fraudulent information you supply through this website
  • Your wrongful or unauthorised use of this website

8. Intellectual property

All content on this website, including text, graphics, logos, icons, images, software, and the selection and arrangement of that content, is owned by us or our licensors and is protected by Australian and international copyright, trade mark and other intellectual property laws. You may not reproduce, modify, distribute, transmit, display, publish, sell, license, create derivative works from, or use any content on this website for any commercial purpose without our prior written consent.

Trade marks, service marks and logos appearing on this website are the property of their respective owners. Nothing on this website should be construed as granting any licence or right to use any trade mark without the written permission of the owner.

We do not endorse, control or accept any responsibility for the content of any third-party website, and we are not liable for any loss or damage arising from your use of any third-party website.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire agreement

These Terms, together with our Privacy Policy and any specific terms notified to you at the time of booking, constitute the entire agreement between you and us in relation to your use of this website and supersede any prior agreement, representation or understanding.
